THE ENFORCEMENT AND CHALLENGES TO MARITIME CLAIMS IN A DIGITAL ERA

Abstract

The rapid digitalization of the global maritime industry has significantly transformed the enforcement of maritime claims and the protection of mortgage interests in contemporary admiralty practice. Technological innovations such as electronic bills of lading, digital ship registries, block-chain transactions, automated shipping systems, and electronic payment platforms have improved efficiency in maritime commerce while simultaneously creating new legal and procedural challenges for mortgagees. The paper examined the enforcement of maritime claims by ranking and the emerging challenges confronting mortgagees in the digital era. The authors analysed the traditional hierarchy of maritime claims, including maritime liens, statutory claims, and registered ship mortgages, and evaluated how digital technologies influenced the enforcement and prioritization of such claims. Particular attention was given to issues relating to cyber-security threats, digital fraud, electronic documentation, cross-border jurisdictional disputes, and the recognition of digitally created security interests. The authors explored the adequacy of existing admiralty laws in addressing disputes arising from digital shipping operations and virtual maritime transactions. Adopting a doctrinal and comparative legal methodology, the paper relied on international conventions, statutes, judicial authorities, and scholarly literature. The paper maintained that while digitalization enhanced efficiency in maritime transactions, inadequate legal harmonization and weak regulatory frameworks exposed mortgagees to increased enforcement risks. The paper therefore concluded that recommending comprehensive legal reforms, digital regulatory standards, and stronger international cooperation ensured effective maritime claim enforcement in the evolving digital maritime environment.
